Court strikes out suit against Yar’adua’s election – Daily Trust

November 18, 2009 by Bunmi Awolusi

The Court of Appeal in Abuja yesterday struck out the petition filed by the Presidential Candidate of Hope Democratic Party (HDP) in the 2007 elections, Chief Ambrose Owuru challenging the election of President Umaru Musa Yar’adua. The petitioner in his statement of claim asked the court to hold that Yar’adua’s election was fraught with irregularities and did not follow the provisions of Electoral Act 2006.

The five-member panel’s ruling delivered by Justice Ayobode Lokulo Sodipe said the petitioner Owuru failed to comply with the provisions of Section 3 (1) of the election petition’s practice direction and that he did not file any application for a pre-trial conference as required by the court’s practice direction in relation with election matters.
