Fed Govt appeals verdict on Vaswani brothers’ deportation – The Nation

November 10, 2009 by Bunmi Awolusi

The Federal Government has appealed the judgment of Mr. Justice Mohammed Liman of the Federal High Court, Lagos, invalidating the deportation of the Vaswani brothers and their foreign members of staff.

It has asked the Federal High Court to stay the execution of its judgment delivered on November 4, until the determination of the appeal filed at the Court of Appeal, Lagos division.

Its request for a stay of execution is contained in a notice of appeal filed before the trial court yesterday by its lawyer, Chezionu Okpoko.

It raised four grounds of appeal.

The first is that the trial judge erred in law when he assumed jurisdiction on the matter.

It said in law, the municipal courts would not interfere with the exercise of sovereign political powers by the government in withdrawing the expatriate quota of foreigners.
