The suit, filed by Abuja-based lawyer Johnmary Jideobi, challenges Ibas's appointment, arguing that his position is unconstitutional. Jideobi contends that the president has no authority to suspend an elected governor or appoint a sole administrator, a position not mentioned in the 1999 Nigerian Constitution.

The case, which seeks to preserve the integrity of the Constitution, questions the actions that led to Ibas's appointment after the alleged suspension of the elected Governor and Deputy Governor of Rivers State. The court hearing will explore whether the president has the power to make such appointments and suspend duly elected officials.
