Delta State High Court in Effurun has dismissed the preliminary objections raised by Nigerian-American singer Davido, and his company, Davido Music Worldwide Limited, challenging the court's jurisdiction in the breach of contract suit filed against them by Brownhill Investment Company Limited over the annual 'Warri Again Concert.' Trial judge Justice Nduka Obi also rejected objections related to the defamation case filed against them.
The court dismissed arguments by the defendants, asserting that the breach of contract matter was a debt recovery case and premature. The ruling affirmed the nature of the case as a breach of contract action and emphasized that no letter of demand was required before filing.
In the defamation case, the court established territorial jurisdiction, considering the claimant's residence in Delta State during the alleged defamatory online statements. While efforts for an out-of-court settlement were mentioned, concrete arrangements remain elusive as the defendants seek terms rejected by the claimant, Brownhill Investment Company Limited, which seeks N2 billion in general damages.
The court has adjourned to hear all cases filed against the defendants.
