In a groundbreaking decision, Mrs. Justice May of the United Kingdom High Court has granted over 13,000 farmers and fishermen from the Niger Delta communities of Ogale and Bille the permission to proceed with their claims against Shell.
The communities allege that chronic pollution of their water sources and the destruction of their livelihoods violate their right to a clean environment. Shell contends that oil theft in the Niger Delta is a primary cause of pollution, emphasizing its adherence to Nigerian regulations and the remediation of spills.
As the communities prepare for a trial on December 12 and 13, Shell maintains its stance, denying a direct duty of care to the claimants and asserting its commitment to remaining in Nigeria despite plans to reduce onshore oil production.
