The Court of Appeal in Abuja has ruled unanimously to nullify the election victory of Senator Simon Mwadkwon, who serves as the Senate Minority Leader, representing Plateau North Senatorial District in the National Assembly. The court's decision was based on its view that the Peoples Democratic Party (PDP) did not validly nominate Mwadkwon.
The panel, led by Justice Daudu Williams, found that the PDP failed to fully comply with court orders as 12 Local Government Areas (LGAs) did not participate in the congress. Furthermore, the court referenced non-compliance with a previous court order from the Plateau State High Court issued in 2020, requiring the PDP to conduct a congress before nominations, as a key factor in their decision
As a result of this judgment, the court ordered a rerun for the Plateau North Senatorial seat, which is to be conducted within 90 days. Additionally, the Appellate court panel, led by Justice Okon Abang, nullified the election victory of PDP's Musa Avia, who represents Bassa North in the House of Representatives
