In a recent development, Justice Njideka Nwosu-Iheme of the Federal Capital Territory High Court in Wuse Zone 2 has dismissed the no-case submission put forth by Peter Nwachukwu, the husband of the late gospel singer, Osinachi Nwachukwu. The Federal Government had filed a 23-count charge against Nwachukwu, alleging his involvement in the death of Osinachi.
Justice Nwosu-Iheme, in delivering her ruling, held that the prosecution had successfully established a case against the defendant. This decision followed a trial that began on June 20, 2022, and concluded on March 10, 2023, during which the prosecution presented 17 witnesses.
The case stems from the tragic death of Mrs. Osinachi, initially believed to have succumbed to throat cancer. However, her family and friends contended that her demise was linked to assault by her husband, leading to his arrest. An autopsy report from the National Hospital in Abuja indicated no signs of violence on the deceased but listed the cause of death as "generalized organ pallor," bilateral leg swelling, fluid around the heart sac, tumor deposits in and on vital organs, a massively enlarged heart, and fluid around the lungs impeding breathing.
In response, Mr. Nwachukwu's counsel, I.A. Aliyu, filed a no-case submission, arguing that the evidence provided by medical practitioners absolved his client of culpable homicide and domestic violence. The court, however, dismissed this submission, compelling the defendant to present his defense in the case
