Lagos lawyer and human rights activist, Chief Femi Falana (SAN) has described as undemocratic tactics akin to dictatorship the calls by certain person for President Goodluck Jonathan to extend the state of emergency he declared in the three North-east states of Borno, Yobe and Adamawa.
Specifically, Falana was referring to a statement in the credited to elder statesman, Chief Edwin Clark in which he urged the president to declare a total state of emergency which would entail that the state governors are removed from office the way former President Olusegun Obasanjo did in Plateau State during his tenure.
“There is nothing like partial declaration of a state of emergency in the 1999 Constitution; what section 305 (c) of the Constitution contemplates is the recourse to ‘extraordinary measures to restore peace’ and security where there is a breakdown of public order and public safety. This in effect means that all democratic institution should be suspended to permit the military exercise full control until peace and order returns,” Clark was quoted to have said.
